Terms and Conditions of Use

Effective Date: April 17, 2025

These Terms and Conditions (“Terms”) govern access to and use of the digital platform available at www.getmade.in (the “Platform”), which is operated by Red Tripartita de Servicios Digitales S.A.P.I. de C.V., a company legally incorporated under the laws of the United Mexican States, with its registered office in Mexico City (hereinafter referred to as “Made in,” “we,” or “our”).

By accessing, registering, or using the Platform in any way, you expressly agree to be bound by these Terms. If you do not agree with them, you must refrain from using the Platform.

1. Legal Entity and Jurisdiction

The services offered in Mexico through this Platform are provided by: Red Tripartita de Servicios Digitales S.A.P.I. de C.V., located in Mexico City, Mexico. Any disputes shall be resolved in accordance with the applicable laws of the United Mexican States before the competent courts of Mexico City.

2. Services Provided

Made in is a B2B digital platform that facilitates connections between companies seeking manufacturing services and qualified manufacturers in North America. Available services include, but are not limited to:

  • Digital quoting and bidding

  • Smart matchmaking algorithms between manufacturers and clients

  • Logistics coordination and order tracking

  • Payment processing

  • Communication and project management tools

Made in acts solely as a technology intermediary and does not guarantee or assume responsibility for the quality, legality, compliance, or delivery of the products or services offered by contracting parties (manufacturers or buyers).

3. User Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 18 years old or of legal age in your jurisdiction.

  • You have full legal capacity to enter into binding contracts, either personally or on behalf of a legal entity.

  • The information provided during registration is true, complete, and up-to-date.

4. Account Registration

To access certain features, you must create a user account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.

Made in may suspend or cancel accounts that, at its sole discretion, violate these Terms or any applicable law.

5. Intellectual Property

All content, software, technology, trademarks, logos, designs, and materials available on the Platform are the exclusive property of Made in or its licensors and are protected under Mexican and international intellectual property laws.

A limited, non-exclusive, non-transferable, and revocable license is granted to users to access and use the Platform for lawful commercial purposes. Unauthorized use, reproduction, distribution, or exploitation of the content is strictly prohibited.

6. Pricing and Payments

Service prices will be clearly displayed prior to any transaction. By completing a transaction, you authorize Made in and its payment service providers to process the corresponding charge.

Made in reserves the right to modify fees, commissions, or billing structures, with prior notice to users.

7. Limitation of Liability and Disclaimer of Warranties

To the fullest extent permitted by law:

  • The Platform and all related services are provided “as is” and “as available,” without any warranties, express or implied.

  • Made in does not guarantee results, uninterrupted service, or error-free operation.

  • Made in shall not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of revenue, reputation, data, or operational interruptions resulting from use of the Platform.

8. Indemnification

You agree to indemnify, defend, and hold harmless Made in, its legal entity in Mexico, its officers, employees, agents, and affiliates from any claim, damage, loss, cost, or expense (including legal fees) arising from:

  • Misuse of the Platform

  • Violation of these Terms

  • Breach of any law or third-party rights

9. Termination

Made in may suspend or terminate, in whole or in part, your access to the Platform at any time, without prior notice, if it detects any breach of these Terms or applicable laws.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute arising from them shall be submitted to the competent courts of Mexico City, expressly waiving any other jurisdiction that may apply due to your present or future domicile.

11. Modifications

Made in may modify these Terms at any time. Modifications will be communicated through the Platform or by email. Continued use of the Platform after such notifications constitutes acceptance of the new Terms.

12. Privacy Notice

We invite you to review our Privacy Notice, which forms an integral part of these Terms and explains how we collect, use, and protect your personal data.
